{"id":12551,"date":"2015-03-30T14:09:01","date_gmt":"2015-03-30T06:09:01","guid":{"rendered":"http:\/\/www.therocket.com.my\/en\/?p=12551"},"modified":"2015-03-30T14:27:54","modified_gmt":"2015-03-30T06:27:54","slug":"explain-ex-gratia-payment-in-tanjong-piai-project-johor-state-government-told","status":"publish","type":"post","link":"https:\/\/www.therocket.com.my\/en\/explain-ex-gratia-payment-in-tanjong-piai-project-johor-state-government-told\/","title":{"rendered":"Explain &#8220;ex gratia&#8221; payment in Tanjong Piai project, Johor state government told"},"content":{"rendered":"<div id=\"attachment_12552\" style=\"width: 424px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/03\/Tanjung-Piai-Maritime-Park.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-12552\" class=\"wp-image-12552\" src=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/03\/Tanjung-Piai-Maritime-Park.jpg\" alt=\"Tanjung Piai Maritime Park\" width=\"414\" height=\"585\" \/><\/a><p id=\"caption-attachment-12552\" class=\"wp-caption-text\">The land reclamation project location<\/p><\/div>\n<p>DAP Johor\u2019s agricultural biro has urged the state government to clarify its spending in for the Tanjong Piai\u00a0Maritime Industrial Park development project\u00a0which will affect the livelihood of local fishermen.<\/p>\n<p>In a joint statement by DAP Johor\u2019s Agriculture and Rural Development Biro leaders, it questioned whether the\u00a0ex-gratia severance payments made to fishermen constituted an admission that the project would cause pollution and loss of economic opportunities for the fishermen.<\/p>\n<p>\u201cFirstly, why is there an ex gratia severance for these fishermen?\u201d asked Mahdzir Ibrahim (DAP Johor\u2019s Agriculture and Rural Development Biro Chief), Lim Eng Guan (Bekok State Assemblyman), Yeo Tung Siong (Pekan Nenas State Assemblyman) and Cheo Yee How (Pengkalan Rinting State Assemblyman) in a joint statement.<\/p>\n<p>He said that an ex-gratia is paid to compensate for damages or occurrences of natural disasters \u2013 where property is destroyed).<\/p>\n<p>\u201cTherefore, the ex-gratia as stated by the minister implies that there was either a natural disaster or that the waters were polluted , which resulted in a 50 percent loss of income source for 1023 fishermen from 14 and 19 sites in Johor Bahru and Pontian respectively,\u201d they said.<\/p>\n<div id=\"attachment_12553\" style=\"width: 342px\" class=\"wp-caption alignleft\"><a href=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/03\/WIRA0775.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-12553\" class=\"wp-image-12553\" style=\"padding-right: 20px;\" src=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/03\/WIRA0775.jpg\" alt=\"WIRA0775\" width=\"332\" height=\"221\" \/><\/a><p id=\"caption-attachment-12553\" class=\"wp-caption-text\">Mahdzir Ibrahim, DAP Johor\u2019s Agriculture and Rural Development Biro Chief<\/p><\/div>\n<p>Prior to this, the state government had claimed that the developer\u2019s (Forest City and and Benelac) projects would positively impact the economy and the livelihood of the locals.<\/p>\n<p>\u201cThe statement by the minister had turned comical when he referred to the ex-gratia as a \u2018consolation\u2019 to the fishermen,\u201d they added, explaining that the ex-gratia and consolatory payments are different.<\/p>\n<p>While ex-gratia has a mechanism and a specific evaluation structure, consolatory payments are given out of courtesy by the government.<\/p>\n<p>\u201cSo which was it then, an ex-gratia, or a consolatory payment?\u201d they asked.<\/p>\n<p>The DAP claims that the\u00a0response by the government on the matter was vague and confusing.<\/p>\n<p>The issue was raised in Parliament on March 24, where Minister of Agriculture and Agro-Based Industry Ismail Sabri said that ex-gratia will be paid out to fishermen whose earnings are projected to be halved. This is due to the land reclamation work for the RM 600 billion mixed development Forest City and the Tanjung Piai Maritime Industrial Park projects affecting the condition of the waters, where the fishermen earn a living.<\/p>\n<p>Apart from the vague clarification by Ismail Sabri, the DAP Biro questioned where the state gratia payment was taken from.<\/p>\n<p>\u201cThe state government? The ministry? Or both?\u201d they asked.<\/p>\n<p>In the case that any of these parties had contributed to the ex-gratia, they said, the function of Tabung Pembangunan Nelayan (Fishery Development Fund) would come into question.<\/p>\n<p>\u201cIn the case of Forest City, the state government, in July 2014, announced the setting up of the fund and estimated a collection of around RM 104 million through the RM 0.30 charge per squared feet (psf) from 3237.48 hectares,\u201d they said.<\/p>\n<p>However, in November 2014 during the Johor State Budget meeting, MB Khaled Nordin announced that RM 1.8 million would be allocated as incentives for 1800 fishermen \u2013 RM 1000 per family.<\/p>\n<p>\u201cThis does not come up to even 10 percent of the RM 104 million as announced in July,\u201d they said.<\/p>\n<p>They also asked whether the Fishery Development Fund paid for the development of Tanjong Piai Maritime Industrial Park.<\/p>\n<p>\u201cWhere was the ex-gratia payment as stated by the Agriculture Minister sourced from?
