{"id":12180,"date":"2015-02-24T12:09:37","date_gmt":"2015-02-24T04:09:37","guid":{"rendered":"http:\/\/www.therocket.com.my\/en\/?p=12180"},"modified":"2015-02-24T12:09:59","modified_gmt":"2015-02-24T04:09:59","slug":"the-mysterious-missing-monies-of-1mdb","status":"publish","type":"post","link":"https:\/\/www.therocket.com.my\/en\/the-mysterious-missing-monies-of-1mdb\/","title":{"rendered":"The Mysterious Missing Monies of 1MDB"},"content":{"rendered":"<p class=\"p1\"><strong>By Pauline Wong<\/strong><\/p>\n<p class=\"p1\"><a href=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/02\/imdb-L.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright  wp-image-12185\" src=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2015\/02\/imdb-L.jpg\" alt=\"imdb-L\" width=\"818\" height=\"409\" \/><\/a><\/p>\n<p class=\"p1\"><span class=\"s1\">In the Christopher Nolan 2010 hit movie, Inception, the protagonist is a thief with the ability to enter one\u2019s dreams and steal secrets and information from a person\u2019s subconscious. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The science fiction thriller was a hit for many reasons, not least for its complicated story and the premise that within our consciousness there are secrets to be \u2018extracted\u2019.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the movie, these \u2018extractions\u2019 can be done covertly by inducing a deep \u2018layered\u2019 dream state in the person whose consciousness the secrets are held; a dream within a dream within a dream, to put it simply.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The ongoing scandal of the debt-ridden 1Malaysia Development Berhad (1MDB) puts into mind this same premise: a scandal within a scandal, inside a cover-up, involving billions of (allegedly) public money. (See accompanying story:\u00a0<a href=\"http:\/\/www.therocket.com.my\/en\/1mdb-whats-going-on\">1MDB: What&#8217;s Going On?<\/a>)<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the latest development to the story, DAP lawmaker Tony Pua has highlighted that there is at least US$1.1 billion of money which is \u2018missing\u2019, shrouded in ambiguous statements from 1MDB\u2019s newly-appointed chief, Arul Kanda Kandasamy, and allegedly hidden in offshore accounts and \u2018creative accounting\u2019. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>The mysterious US$700 million debt<\/b><\/span><\/p>\n<div id=\"attachment_11272\" style=\"width: 386px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2014\/12\/02.02.2012-PC-Tony-Pua-NFC-audited-account-hq-dap-1.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-11272\" class=\" wp-image-11272\" src=\"http:\/\/www.therocket.com.my\/en\/wp-content\/uploads\/2014\/12\/02.02.2012-PC-Tony-Pua-NFC-audited-account-hq-dap-1.jpg\" alt=\"PAC member and DAP National Publicity Secretary Tony Pua \" width=\"376\" height=\"250\" \/><\/a><p id=\"caption-attachment-11272\" class=\"wp-caption-text\">PAC member and DAP National Publicity Secretary Tony Pua<\/p><\/div>\n<p class=\"p1\"><span class=\"s1\">At a press conference today, Pua who is also a member of the Public Accounts Committee (PAC) said the trail leads as far back as 2009 with a dubious joint-venture (JV) company with Petrosaudi International Limited (PSI) and 1MDB, called 1MDB Petrosaudi Limited, which had a US$700 million existing debt.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua was responding to an exclusive <a href=\"http:\/\/www.sarawakreport.org\/2015\/02\/the-dodgy-700000000m-loan-deal-at-the-heart-of-1mdbs-mega-debt-crisis-exclusive\/\">expose<\/a> by whistleblower site the Sarawak Report, which details the dubious \u2018cover-up\u2019 of the mysterious US$700 million debt.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Where the aspersions are cast is the timeline in which this joint venture agreement was signed.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua said according to the <\/span><a href=\"http:\/\/documents.sarawakreport.org\/petro-saudi-1mdb.pdf%20\"><span class=\"s2\">documents<\/span><\/a><span class=\"s1\">\u00a0which the Sarawak Report revealed, the JV company was incorporated on Sept 18, 2009 as a wholly-owned subsidiary of PSI. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The JV company had US$700 million in debt as \u2018advances\u2019 owing to PSI, but the nature of these \u2018advances\u2019 remains unexplained. The JV agreement signed on Sept 28, 2009 included, among others, that 1MDB would be responsible for paying back this debt to PSI. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Subsequently, 1MDB \u2018paid off\u2019 this debt by buying 40 per cent of shares in the JV company, worth US$1 billion. Almost immediately after the JV agreement was signed, the US$700 million was paid back to PSI. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua in a previous statement likened the move to \u2018invest\u2019 in a company with such a huge debt to<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201cbuying a house that has a great big loan of two thirds of its market value outstanding on the property,\u201d and said that nobody in their right minds would buy a property like that.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cI definitely suspect foul play in the (US$700 million). I would be very interested to know whose account the US$700 million went into,\u201d he added at the press conference this morning. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua said the explanations provided by Arul Kanda was disappointing and \u201cobviously evasive.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cArul Kanda said that the JV was terminated six months later in March 31, 2010.<span class=\"Apple-converted-space\">\u00a0 <\/span>The US$1 billion investment was revalued to US$1.2 billion and \u201cconverted into Murabaha notes\u201d or an Islamic loan to the Petrosaudi subsidiary.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua said the 1MDB CEO was reported as stating that \u201cthese Murabaha notes were paid back in full, with 1MDB earning a profit of US$488 million, in 2013\u201d.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cArul Kanda completely avoided dealing with the brazen attempt to siphon the US$700 million out of 1MDB to Petrosaudi or its nominees, which in itself is a blatant failure of the directors\u2019 fiduciary duty and corporate governance,\u201d Pua said. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Conversion of a bad investment into a dodgy loan?<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Pua said the move to re-invest in a failed JV company was \u2018mind-boggling\u2019.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The Petaling Jaya Utara MP said that if the JV had failed, why did 1MDB not simply pull out of the whole investment entirely, instead of converting the investment into yet another loan?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe funds which was raised via a debt guaranteed by the Malaysian federal government (the initial US$1 billion) was inexplicably extended as a Murabaha loan to the Petrosaudi subsidiary,\u201d he said, adding that the conversion of the investment appeared to be a \u2018con job\u2019 and \u2018cover-up\u2019. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cBy converting the money into a loan to Petrosaudi, 1MDB was able to avoid reporting the details of the JV agreement in its 2010 financial report,\u201d he claimed.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Furthermore, Pua said in September 2012, the Murabaha notes were sold off to an undisclosed party for US2.318 billion, allegedly giving 1MDB the \u2018profit\u2019 of US$488 million (as mentioned by Arul Kanda). <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">However, the US$2.318 billion was not returned to the company, but was instead invested in a segregated portfolio company in the Cayman Islands. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The US$2.318 billion was reportedly redeemed in full at the start of this year, according to Arul Kanda, but while half that amount has been repatriated back to Malaysia to pay off 1MDB\u2019s outstanding debts, the remaining US$1.103 billion remains \u201cmissing.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The profit of US$488 million, Pua claims, is also \u201cmissing.\u201d <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cWhat we have at hand is at least US$1.1 billion missing in unknown whereabouts.
